From there, the Department of Insurance will take over investigation of this claim and possible prosecution under criminal law. After all, workers' compensation fraud is a crime that may be punishable by imprisonment, fines, and other criminal penalties. If a worker commits fraud, he or she may also be ineligible to receive the benefits that he or she would have originally been entitled to.
